In previous blog entries we have discussed the May 2016 U.S. Department of Labor Final Rule amending the Fair Labor Standards Act (FLSA) regulations related to the exemption from minimum wage and overtime pay for executive, administrative and professional employees (the EAP exemption) and for highly compensated employees (the HCE exemption). The Final rule is effective on December 1, 2016.
The rules surrounding this issue are complex but the Final rule substantially changed the minimum salary level to qualify for the EAP exemption to $47,476 from the previous amount of $23,660. Therefore, employees making below this amount cannot be considered exempt …read more
