The Freedom of Information Act (FOIA), codified at 5 U.S.C.§552, gives any person the right to obtain records held by Federal agencies, except to the extent the records are protected from public disclosure by one of nine exemptions.* While there have always been protections in place for business secrets, The Freedom of Information Act (FOIA) Improvement Act of 2016 (The Act) requires a heighted standard be met to protect information from disclosure where disclosure is discretionary.
