Alert! DoD Weighs in on Cost-Type Contract Awards

On January 29th, 2014, the Department of Defense (DoD) issued an interim final rule amending the Defense Federal Acquisition Regulations (DFARs) to prohibit the DoD from entering into cost-type contracts for the production of major defense acquisition programs unless they had a certification to Congress from the Under Secretary of Defense for Acquisition, Technology, and Logistics. The interim rule implements Section 811 of the National Defense Authorization Act (NDAA) for Fiscal Year 2013, which dictates the prohibition and establishes an October 2014 deadline.
